Welcome to Valen Sey. These Terms of Service ("Terms") govern your access to and use of thevalensey.com (the "Site") and any purchase you make through it. By visiting the Site, creating an account, or placing an order, you agree to these Terms. If you don't agree with them, please don't use the Site.

1. Who We Are

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to place an order on the Site. If you are under 18, you may browse the Site and use the Skin Assessment only with the involvement and consent of a parent or legal guardian, who must complete any purchase on your behalf.

3. Your Account

Creating an account is optional but gives you order history, faster checkout, and access to your saved ritual. You're responsible for:

  • Keeping your login credentials confidential.
  • All activity that occurs under your account.
  • Notifying us immediately at contact@thevalensey.com if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or are used for fraudulent or abusive activity.

4. Products, Pricing & Availability

  • All prices are displayed in the currency shown at checkout and are subject to change without notice. The price charged is the price displayed at the time your order is confirmed.
  • We make every effort to display product colours, textures, and packaging accurately, but slight variations may occur due to screen settings, batch variation, or natural ingredient variability — this is a feature of whole-plant, bio-active formulation, not a defect.
  • Products are subject to availability. If an item becomes unavailable after you've ordered it, we will notify you and offer a refund, substitute, or backorder option.
  • We reserve the right to limit quantities purchasable per person, per household, or per order, at our discretion, including to prevent resale or fraud.

5. Orders & Our Right to Refuse

Placing an order is an offer to purchase, which we're free to accept or decline. We may cancel or refuse any order, at any time, for reasons including but not limited to:

  • Suspected fraud or unauthorised payment use.
  • Errors in product pricing or description (e.g., an obvious mispricing).
  • Inability to fulfil due to stock, shipping restriction, or regulatory limitation in your destination country.
  • Violation of these Terms.

If we cancel a confirmed order, you will receive a full refund of any amount already charged.

6. Payment

Full payment is required at the time of order. We accept the payment methods displayed at checkout, processed through PCI-DSS-compliant third-party payment providers. We do not store your full card details — see our Privacy Policy and Payments & Security page for details on how payment data is handled.

7. Shipping, Customs & Delivery

Shipping timelines, methods, and customs/duty responsibilities are detailed in our Shipping Policy, which forms part of these Terms. In short: orders within the EU/Schengen area move customs-free; orders shipped outside the EU may be subject to import duties and taxes payable by the recipient on arrival.

9. Product Use, Safety & Disclaimers

Your skin's safety matters more to us than any sale. Please read this section carefully.

  • For external, cosmetic use only. Our products are formulated and intended solely for topical cosmetic use as described on each product page. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.
  • Not a substitute for medical advice. If you have a diagnosed skin condition, are pregnant or breastfeeding, or have any concern about how a product may interact with your skin or health, consult a physician or dermatologist before use.
  • Patch test recommended. Before first use of any new product, we recommend applying a small amount to an inconspicuous area of skin (such as the inner forearm) and waiting 24–48 hours to check for a reaction.
  • Discontinue use if irritation occurs. If you experience redness, itching, burning, swelling, or any other adverse reaction, discontinue use immediately, rinse thoroughly, and consult a medical professional if symptoms persist. Please also contact us at contact@thevalensey.com so we can support you and record the report.
  • Keep out of reach of children. Unless a product is specifically labelled for a younger age range.
  • Results vary. Skin response to any formula depends on individual biology, environment, and consistency of use. Marketing descriptions of expected outcomes reflect intended formulation goals and typical use patterns, not a guaranteed result for every individual.
  • Full ingredient transparency. Complete INCI ingredient listings are published on every product page. Please review them against any known allergies or sensitivities before purchasing.

10. Intellectual Property

All content on the Site — including but not limited to the Valen Sey name, logo, "Living Skincare" concept, product photography, written copy, quiz logic, and site design — is owned by or licensed to Valen Sey and protected by copyright, trademark, and other applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from any Site content for commercial purposes without our prior written consent. Ingredient names and formulation science referenced on the Site may be subject to third-party trademarks or certifications (e.g., certification marks awarded by independent certifying bodies), which remain the property of their respective holders.

11. User-Generated Content

If you submit a product review, testimonial, photo, or other content to us (including via email, social media tags, or on-site review tools), you grant Valen Sey a non-exclusive, royalty-free, worldwide, transferable licence to use, reproduce, edit, and display that content across our Site and marketing channels, with attribution where reasonably practicable. You confirm that any content you submit is your own, does not infringe on any third party's rights, and does not contain false, defamatory, or misleading claims.

We reserve the right to remove or decline to publish any submitted content at our discretion.

12. Prohibited Uses

When using the Site, you agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorised access to our systems, accounts, or data.
  • Scrape, harvest, or extract data from the Site using automated means without our written permission.
  • Interfere with or disrupt the Site's functionality, security, or availability.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Use the Site to transmit malware, spam, or unsolicited communications.
  • Resell products purchased through the Site in a manner that violates applicable law or these Terms, without our prior written authorisation as an approved reseller.

13. Third-Party Links & Services

The Site may contain links to third-party websites or integrate third-party services (payment providers, social platforms, analytics tools). We do not control and are not responsible for the content, policies, or practices of any third-party site or service. Your use of third-party services is governed by their own terms and privacy policies.

14. Limitation of Liability

To the fullest extent permitted by applicable law:

  • The Site and its content are provided "as is" and "as available," without warranties of any kind, express or implied, except where such warranties cannot be excluded under applicable law (including mandatory consumer protection law in your jurisdiction).
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products purchased through it, including loss of profits, data, or goodwill.
  • Our total liability for any claim arising from your order is limited to the amount you paid for the product(s) giving rise to the claim.
  • Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or defective products under applicable product liability law.

15. Indemnification

You agree to indemnify and hold Valen Sey, its operator, and any affiliated partners harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your violation of these Terms, misuse of the Site, or infringement of any third party's rights.

16. Governing Law & Your Consumer Rights

These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence apply and cannot be waived by agreement — in which case, those mandatory protections remain in full effect regardless of this clause. Nothing in these Terms limits any statutory right you hold as a consumer under the law of the European Union, United Kingdom, United States, or other applicable jurisdiction.

Online Dispute Resolution (EU consumers): the European Commission provides an Online Dispute Resolution platform at ec.europa.eu/consumers/odr, which you may use to resolve disputes without going to court. You may also contact your national consumer protection authority, or in Lithuania, the State Consumer Rights Protection Authority (Valstybinė vartotojų teisių apsaugos tarnyba).

17. Force Majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, labour disputes, carrier delays, customs holds, government action, or supply chain disruption.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, offerings, or legal requirements. The "Last updated" date above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. For material changes, we will provide reasonable notice via the Site.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
